The business relations between Company Willy Maisel GmbH and the Customer shall be governed exclusively by the following Terms and Conditions. They relate only to orders concluded by Consumers as per section § 13 BGB.
Company Willy Maisel GmbH does not accept orders from customers who have not yet completed their 18th year.
Right of Withdrawal:
You are entitled to withdraw from this contract within fourteen days of concluding it without stating a reason therefor. The cancellation period comprises fourteen days from the day on which you or any third party that is not the carrier and had been appointed by you took possession of the goods. In order to exercise your right of withdrawal, you need to inform us (Company Willy Maisel GmbH, Münchberger Straße 46, 95176 Konradsreuth, support@world-of-textiles.com, Tel .: 09292 / 519-500, Fax: 09292 / 519-720) about your decision of withdrawing from this contract. You may use the attached [cancellation form template]; it is, however, not compulsory. In order to keep the cancellation deadline, it is sufficient to dispatch the notification stating your intent to exercise the cancellation right before the cancellation period expires.
The right of withdrawal pursuant to section § 312g para. 2 no. 1 BGB does not apply to contracts for the delivery of goods which are not prefabricated and for the production of which an individual choice or decision by the consumer is required or which are clearly tailored to the personal needs of the Consumer.
Consequences of the Withdrawal:
If you withdraw from this contract, we are obliged to refund all payments we have received from you including the shipping charges (except for additional costs arising if you chose a method of shipping different from the most cost-efficient standard delivery offered by us) without delay and at the latest within fourteen days from the day on which we received the notice of cancellation. We will issue the refund using the same method of payment that you selected for the original transaction, unless expressly agreed with you otherwise; under no circumstances will you be charged a fee for this refund. We may withhold the refund until the goods have been returned to us or until you have provided evidence that you have shipped the goods, whichever comes first. You must ship or deliver the goods back to us immediately and in any event no later than fourteen days from the date on which you notified us of your withdrawal from this contract. The deadline shall be considered kept if you dispatch the goods before the fourteen-day deadline has expired. You bear the direct cost of returning the goods. You shall only be liable for the potential loss in value of the goods when a test of the condition, characteristics, and functioning of the goods shows that the loss in value was due to improper handling on your end.
The consumer is entitled to warranty for defects of the purchased goods in accordance with the statutory provisions of sections §§ 437 et seq. of the BGB. In particular, the Customer may request additional fulfilment (a new delivery or a rectification of deficiencies). However, Company Willy Maisel GmbH is entitled to refer the customer to a new delivery should the deficiency rectification procedure involve a disproportionate effort. The warranty claims expire two years after delivery of the goods. In raising his/her claims, the Buyer should state the order number, his/her name and address as well as a brief description of the reasons for the claim. On request of Company Willy Maisel GmbH, the Customer shall send the defective goods for inspection at the expense and risk of Company Willy Maisel GmbH to the following address: Willy Maisel GmbH, Münchberger Str. 46, 95176 Konradsreuth
Company Willy Maisel GmbH accepts, as part of the ordering process, the indicated payment methods such as payment by credit card or prepayment.
The delivered goods remain property of the company Willy Maisel GmbH until paid for in full.
The customer may exercise his/her right to compensation only when his/her counter-claims have been validly established or are uncontested by Company Willy Maisel GmbH. The customer may exercise a right of retention only if and to the extent that his/her counter-claim is based on the same contractual relationship.
The personal data of customers that become known to Company Willy Maisel GmbH as part of a business relationship are stored and, if necessary, passed on to associated companies for the purpose of processing the order. All data shall of course be treated confidentially. The data are collected, stored and used by us according to the applicable privacy policy of Company Willy Maisel GmbH. These data provisions can be retrieved here in printable form.
The purchase order text shall not be stored by us and can no longer be accessed after the ordering process has been completed. The information from the ordering process will be sent to you once again with the e-mail confirming your order. In addition to this, you can print out your order data as soon as the order is dispatched.
All contracts between the company Willy Maisel GmbH and the customer shall be governed by the law of the Federal Republic of Germany, excluding the CISG. This choice of law applies only insofar as this shall not detract mandatory applicable consumer protection legislation of the country in which the Consumer resides at the time his/her purchase is placed.
